Group companies may use the information in accordance with their own privacy policies for purposes such as: financial reporting and analysis, strategic planning, customer segmentation and metrics to provide a consistent view of our customer base, creating inspiring content and editorial features, and developing new products and collaborations to enhance your experience as a customer of D.S. & Durga and other group brands.
We engage trusted companies and individuals to perform functions on our behalf, to operate and improve our Site and services. We may share your personal information with:
- Service providers, suppliers, and sub-contractors (including group companies) for the performance of any contract we enter into with them or you, such as processing orders, maintaining your account, authorizing and validating credit or debit card transactions, providing delivery services, and analyzing data. These parties may be provided with access to your personal information only to perform their functions and may not use it for other purposes.
- Advertisers and advertising networks to select and serve relevant adverts to you and others. Online retargeting is a form of online advertising that allows us and our advertising partners to show you advertising based on your browsing patterns and interactions with our Site. For example, when you have visited our Site then move to another site, you may start seeing our adverts displaying special offers or reminding you of the products you were browsing on our Site. The technology behind these adverts is based on cookies and other technologies such as tags and pixels. You can adjust your cookie preferences via our Cookie Banner. Information may be shared during the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction.
We may share your personal information where required to comply with legal obligations, enforce our terms and conditions or other agreements, protect our rights, property, or safety or that of our customers or others. This may include exchanging information with other companies and organizations for fraud protection and credit risk reduction, as well as with government bodies, dispute resolution organizations, law enforcement agencies, or third parties in connection with responding to a subpoena, search warrant, or other lawful request for information or cooperating in a law enforcement or similar investigation.
Where we store and process your personal information
The personal information we collect from you may be transferred to and stored in countries outside the one where it was originally collected, including jurisdictions that may have less stringent – or no – data protection laws compared to those in your country of residence.
These transfers occur because certain operations necessary to fulfil our contract with you are managed outside your country. For example, your data may be processed by staff located abroad who work for us or for one of our service providers. Such staff may be involved in activities such as fulfilling your order, processing payment details, or providing support services.
Where your personal information is transferred in this way, we take all steps reasonably necessary to ensure adequate safeguards are in place to ensure your personal information is treated securely and in accordance with this Privacy Policy. In these cases, we rely on approved data transfer mechanisms (such as standard contractual clauses) to ensure your information is subject to adequate safeguards in the recipient country.
Security and passwords
We maintain reasonable technical and organizational measures to protect personal information from loss, misuse, alteration, or unintentional destruction. Our security measures are designed to make sure that personal information we collect and store (including transactional information) is protected. Transactional information includes credit and debit card details, your personal contact information, names and addresses provided for delivery, and your purchasing history.
If you have consented during the ordering process, our Site will retain your D.S. & Durga account details (such as your name, address, email address, and purchase history). For security reasons, you must re-enter your credit card details each time you place a new order.
Where we have provided you (or you have chosen) a password to access certain parts of our Site, you are responsible for keeping this password confidential. Please do not share it with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. While we take steps to protect your personal information, we cannot guarantee its security during transmission to our Site; any transmission is at your own risk. Once we receive your information, we apply strict procedures and security features to help prevent unauthorized access.
Third-party websites
Our Site may include links to websites operated by partner networks, advertisers, and affiliates. If you follow a link to any of these websites, please note that they have their own privacy policies. We do not accept responsibility or liability for those policies. Please reviewing the privacy policies of any third-party websites before submitting personal information.
Data retention and destruction
We store personal information for as long as necessary to provide products and services to you and others, and for as long as we are legally required to do so. In some cases, we may also keep records of correspondence (for example, if you have made a complaint) for as long as needed to protect us against potential legal claims.
Your rights as a data subject
You have certain rights regarding your personal information, including the right to object to the processing of your information for certain purposes, the right to access your personal information, and the right to request erasure, restriction, or receipt of a machine-readable copy of your personal information (subject to certain exceptions).
We will handle any request to exercise your rights in accordance with applicable law and relevant legal exemptions. To exercise your rights, please contact us using the details below.
You may also have the right to complain to a data protection authority if you think we have processed your personal information unlawfully or in breach of your rights. If you have concerns, we encourage you to contact us first so we can investigate and hopefully resolve your concerns.
Additional disclosures for residents of certain US states
For residents of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, the additional disclosures in this section are intended to supplement this Privacy Policy with information required by the laws in those states.
The sources and categories of personal information we may have collected from you in the past 12 months are described in the “How and when we collect personal information” and the “Personal information we collect about you” sections above. We also explain how we use personal information in the “How we use your personal information” above.
We may share personal information with the categories of third parties listed in “Disclosure of your information” above. Below, we have provided more detail regarding the two ways we share personal information: (i) “sales” of information and (ii) general disclosures for a business purpose.
“Sales” of Information
We have marked “sales” in quotation marks because a “sale” under certain state laws broadly includes any disclosure of information in return for any value. This value does not need to be monetary, like in a traditional sale.
D.S. & Durga does not share personal information in exchange for payment and we require that our suppliers and subcontractors only use your personal information to perform the services we have asked of them. With your consent, and as noted above, we use advertising networks to select and serve relevant adverts to you and have provided information to them for this purpose.
We do not sell, or have actual knowledge of any sale of, the personal information of minors under 16 years of age.
Disclosures of Information for a Business Purpose
To manage our business and provide services to you, we sometimes share personal information with third parties. As noted above, these third parties cannot further collect, sell, or use the personal information we share with them except as necessary to perform our purposes, as instructed by us.
In the past 12 months, we may have disclosed the following categories of personal information to the following third parties for our operational business purposes:

The section “Rights of Data Subjects” above describes some of the rights you may have as a resident of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia. If you submit a request to exercise any of these rights, we will need to properly verify your identity for security purposes before we process your request. If we possess appropriate information about you (e.g. name, email address), we will attempt to verify your identity using that information. If it is not reasonably possible to identify you, we may not be able to respond to your request.
To use an authorized agent to make a request on your behalf, we may need the authorized agent to provide proof that you gave the authorized agent signed permission to submit the request on your behalf. We may also require you to verify your identity directly with us.
Oregon residents may also request a list of the recipients to whom the personal information has been or will be disclosed.

When you sign up for an Account, we will ask you to provide your name, address, email address, and phone number. The categories of third parties that may receive this information, include service providers that assist us in provisioning our Accounts and online advertising networks for targeted advertising.
We currently do not collect any sensitive personal information in connection our Accounts.
If you request that we delete any of your personal information that is essential to providing you with an Account, we will not be able to provide you with accountholder benefits.
